1. Acceptance of Terms

By purchasing a product from The Pinball King (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions. If you do not agree, you should not complete your purchase.

2. Sales Policy – No Returns or Refunds

All sales are final.

We do not accept returns, cancellations, or offer refunds for any products sold. By completing your purchase, you acknowledge and agree that your order is non-refundable and non-returnable.

Because our machines are custom-built and assembled to order, buyer’s remorse, dissatisfaction, or change of preference does not constitute grounds for return or refund.

3. Shipping and Delivery

We currently ship only within the continental United States.

Delivery timelines are estimates and may vary due to production schedules, freight carrier availability, weather conditions, or other circumstances beyond our control.

Customers are responsible for ensuring that all shipping information provided is accurate and complete.

A signature may be required upon delivery.

4. Shipping Damage Policy

If your machine arrives damaged due to shipping:

• You must notify us within 48 hours of delivery.

• Photographic evidence of the damage and packaging must be provided.

• The original packaging must be retained for inspection if required.

If damage is verified as shipping-related, The Pinball King will determine, at its sole discretion, whether the appropriate remedy is:

• Replacement of the entire machine, or

• Repair of the damaged components, including arranging for a qualified local technician where appropriate.

Our obligation is limited to restoring the product to the condition intended at the time of sale.

We reserve the right to assess the extent and cause of shipping damage before authorizing repair or replacement.

5. Use of Products and Assumption of Risk

Virtual pinball machines contain electronic components, mechanical parts, and moving elements.

By purchasing and using our products, you acknowledge and agree that:

• You assume all risks associated with the use, operation, installation, and maintenance of the machine.

• The Pinball King is not responsible for any injury, damage, loss, or claims arising from the use or misuse of our products.

• We are not liable for incidental, indirect, consequential, or special damages.

Use of the machine is at your own risk.

6. Limitation of Liability

To the maximum extent permitted by law, The Pinball King’s total liability for any claim arising out of or related to the purchase or use of our products shall not exceed the amount paid for the product.

Under no circumstances shall we be liable for:

• Loss of profits

• Business interruption

• Property damage

• Personal injury resulting from improper use

• Any indirect, incidental, or consequential damages

7. Payment Disputes and Chargebacks

By completing a purchase with The Pinball King, you agree not to initiate a chargeback, payment reversal, or dispute with your credit card provider or payment processor without first contacting us to attempt to resolve the issue.

All sales are final and non-refundable as stated in these Terms.

Initiating a chargeback for a valid and delivered order may constitute a breach of this agreement.

In the event of a fraudulent or bad-faith chargeback, The Pinball King reserves the right to:

• Provide these Terms and Conditions as evidence to the payment processor

• Recover any fees, costs, or damages associated with the chargeback

• Pursue collection or legal remedies where permitted by law

8. Warranty

Unless otherwise expressly stated in writing at the time of purchase, products are sold “as is.”

Any manufacturer warranties applicable to individual components (if any) are provided solely by their respective manufacturers.

The Pinball King makes no additional warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

9. Governing Law

These Terms and Conditions shall be governed by and interpreted under the laws of the state in which The Pinball King operates, without regard to conflict of law principles.

10. Modifications

We reserve the right to modify these Terms and Conditions at any time. Updated versions will be posted on this page and will apply to all purchases made thereafter.
